## 1. About these terms

These terms form an agreement between you and Falcata Oy ("Falcata", "we", "us", or "our") when you use the Falcata website, Falcata ID, or another service that refers to these terms. By creating a Falcata ID or using a covered service, you agree to these terms.

If you use a Falcata service on behalf of an organisation, you confirm that you have authority to accept these terms for that organisation.

## 2. Eligibility and accounts

You must be at least 13 years old to create a Falcata ID. If the law where you live requires parental or guardian consent, you must have that consent. A connected application may set a higher minimum age in its own terms.

You must provide accurate account information and keep it current. You are responsible for protecting your password, email account, devices, and active sessions. Tell us promptly at [contact@falcata.io](mailto:contact@falcata.io) if you believe your account or sign-in link has been misused.

You may not create an account for another person without authority, impersonate another person or organisation, or transfer your account to someone else.

## 3. Falcata ID and connected applications

Falcata ID provides a shared identity and authentication service for participating web and mobile applications. A connected application may send you to Falcata ID to confirm your account and then receive your stable account identifier, confirmed email address, display name, and an application-specific signed-in session. It does not receive your password or email-link token from Falcata ID.

Each connected application may have its own product terms, privacy notice, prices, and rules. Those product-specific terms govern your use of that application. These terms govern the shared Falcata identity and services unless the product-specific terms expressly say otherwise.

## 4. Acceptable use

You may use the services only for lawful purposes and in accordance with these terms. You must not:

- gain or attempt to gain unauthorised access to an account, service, system, or network;
- interfere with the operation or security of the services, bypass access controls, or test vulnerabilities without written permission;
- use automated means in a way that overloads, disrupts, scrapes, or damages the services;
- send malware, phishing material, spam, or other deceptive or harmful content;
- use the services to violate another person's rights or applicable law;
- reverse engineer the services except where applicable law expressly permits it; or
- help another person do any of these things.

We may use reasonable technical measures to prevent abuse and protect the services and their users.

## 5. Your responsibility for connected products

Falcata ID confirms identity; it does not control everything a connected application does. You are responsible for reviewing the application's description, product terms, privacy notice, and any transaction before using it. Questions about an application's content, features, purchases, or data practices should be directed to the operator identified by that application.

If Falcata operates the connected application, its product-specific terms will identify Falcata and supplement these terms.

## 6. Service changes and availability

We may add, change, suspend, or discontinue features to maintain security, comply with law, improve the service, or respond to operational needs. We aim to keep the services available but do not guarantee uninterrupted or error-free operation. Maintenance, outages, internet failures, and events outside our reasonable control may affect availability.

Where reasonably possible, we will give advance notice of a material discontinuation that affects an active account.

## 7. Suspension and termination

You may stop using the services at any time. Account deletion may be available in Falcata ID settings; you may also contact us for help.

We may restrict, suspend, or terminate access when reasonably necessary to protect users or the services, investigate suspected misuse, comply with law, or address a material breach of these terms. When appropriate, we will explain the reason and provide a reasonable opportunity to appeal or correct the issue.

Terms that by their nature should continue after termination—including intellectual property, disclaimers, limitations of liability, and dispute terms—remain in effect.

## 8. Intellectual property

Falcata and its licensors own the services, software, designs, names, logos, and related intellectual property. These terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the services as intended. They do not transfer ownership or grant a right to use Falcata's names or marks except as necessary to identify the service.

If you send feedback, you allow us to use it without restriction or payment, provided we do not identify you publicly without permission.

## 9. Privacy

Our [privacy policy](/privacy) explains how Falcata processes personal data. A connected application's privacy notice explains how that application processes the identity and other information it receives.

## 10. Disclaimers

The services are provided on an "as available" basis. To the fullest extent permitted by law, Falcata disclaims implied warranties that are not expressly stated in these terms, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these terms excludes a warranty, remedy, or other right that cannot lawfully be excluded, including mandatory consumer rights.

## 11. Limitation of liability

To the fullest extent permitted by law, Falcata is not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profit, revenue, business, goodwill, or data arising from use of the services.

Falcata's total liability arising from or relating to a free service is limited to EUR 100. For a paid service, Falcata's total liability is limited to the greater of EUR 100 or the amount you paid Falcata for that service during the 12 months before the event giving rise to the claim.

These limits do not apply where liability cannot lawfully be limited, including liability for intentional misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.

## 12. Changes to these terms

We may update these terms when our services or legal obligations change. We will post the updated terms here and change the effective date. If a change materially affects an active account, we will provide additional notice where reasonably possible. Changes do not apply retroactively unless the law requires it.

If you do not agree to an updated term, you should stop using the affected service before the change takes effect.

## 13. Governing law and disputes

These terms are governed by Finnish law, without regard to conflict-of-law rules. If you are a consumer, this does not deprive you of mandatory protections available under the law of your country of residence.

Please contact us first so we can try to resolve a concern. If a dispute cannot be resolved, it may be brought before the competent courts of Finland. Consumers may also bring a claim in the courts available under mandatory consumer law and may contact their local consumer advice service.
